Whether I-140 approval notice required for AC21 filing? Hi,
My I-140 filed in May'07 and got approved in Dec'08. Also in the mean while I filed my I-485 in July'07. When they filed my I-140 my immigration team sends the receipt notice but later they changed the policy that they wont send the approval notice to employees. So they declined me to provide my I-140 approval notice. But if I check my case number for I-140 in uscis site, it is mentioned that my I-140 got approved. Without having I-140 approval notice whether I will be able to use the AC21 portability? In the AC21 letter template it is mentioned that we need to submit the copy of the I-140 approval notice. Please advice |

Re: Whether I-140 approval notice required for AC21 filing? Yes you can file AC 21 as long as you have your case number, also
- can they give you a photocopy of the receipt notice, we have seen this is common with employers because the I-140 belongs to the employer, but many times they are ok with giving a photocopy - if they still refuse, make sure you say so in your AC21 letter (i.e. employer refused to give copy of 140), also take a screen shot of the USCIS case status and send it in place of the receipt. Also keep a copy of the screen shot for your records. Thanks |
