Qeustions about starting new business Hi,
I have a question about starting new business. I am under H1B status now and negotiating about green card process with my current employer, and I am considering starting a new company. So far as I learned, the best way of doing it is apply for a part time H1B for the new company and proceed with green card application with the current employer, and switch job to the new company using AC21 when qualified. Now my questions are the follows: 1. Is this process practically doable? What will be the risk? 2. Is there any better suggestions? 3. In case I am not getting green card sponsorship from my current employer, is it possible for me to self sponsor a green card with the new company? Any advices will be greatly appreciated. |

It is doable, the only question to ask yourself is -are you violating any of your current employers conditions about working elsewhere or for yourself -USCIS is getting pretty strict about issuing H1B's to small companies especially those where majority employees ate H1B in your case at the beginning its just you so it may be an issue 2. Better suggestions - None that you will like... maybe wait till you get your EAD go to your home country and start the business 3. Again the issue is the USCIS getting pretty tough with self employed and small employers. |
